Terms and Conditions for MenuGoal

These Terms and Conditions apply to the use of the macOS application MenuGoal, provided by:

1. Scope

These Terms apply to the use of MenuGoal.

MenuGoal is distributed through Apple’s Mac App Store. Purchases, payments, refunds, downloads, and use of the Mac App Store are also subject to Apple’s applicable terms and licence conditions.

Mandatory consumer rights remain unaffected.

2. Description of the Application

MenuGoal is a macOS menu bar application designed to keep one measurable goal visible while you work.

Users can manually define information such as:

• a current value;
• a target value;
• a custom label;
• a unit or description; and
• related goal preferences.

MenuGoal displays the resulting progress directly in the macOS menu bar.

The app may be used for different types of measurable goals, including revenue, subscribers, customers, sales, content, fitness, or other personal targets.

3. User-Entered Information

MenuGoal relies on values entered manually by the user.

The application does not independently verify whether entered values are accurate, complete, current, or appropriate for the user's intended purpose.

You are responsible for maintaining and updating your goal information.

4. Progress Calculations

MenuGoal may calculate and display progress based on the current value and target entered by the user.

Any percentage, progress indicator, remaining amount, or similar value is based solely on the information provided by the user and the application's calculation logic.

MenuGoal does not guarantee that displaying or tracking a goal will result in achieving that goal.

5. Use for Financial, Health, or Other Goals

MenuGoal is a general-purpose goal tracker.

Users may choose to track values related to finances, fitness, work, business, or other areas.

MenuGoal does not provide financial, investment, medical, health, tax, accounting, legal, or other professional advice.

Values displayed by the application are informational only and should not be used as the sole basis for important professional, financial, health, or legal decisions.

6. Licence

Subject to payment of any applicable purchase price and compliance with these Terms and Apple’s applicable rules, you receive a limited, non-exclusive, non-transferable right to use MenuGoal on compatible Apple devices associated with your App Store account.

The application is licensed, not sold.

You may not unlawfully copy, redistribute, sublicense, reverse engineer, circumvent technical protections, or otherwise use MenuGoal contrary to applicable law or Apple’s terms.

7. Purchase and Refunds

Where MenuGoal is offered as a paid application, purchases are processed through Apple’s Mac App Store.

The price displayed by Apple at the time of purchase applies.

Payment processing, billing, cancellations, and refunds are generally handled by Apple.

Statutory consumer rights remain unaffected.

8. Local Data and User Responsibility

MenuGoal is designed to store and process goal information locally on your Mac.

You are responsible for:

• protecting access to your Mac;
• keeping goal information up to date;
• protecting any sensitive information you choose to enter; and
• maintaining appropriate backups where necessary.

We cannot recover application data that is lost, deleted, overwritten, or corrupted on your device.

9. Accuracy and Availability

We aim to provide a reliable application but cannot guarantee completely uninterrupted or error-free operation.

Functionality may be affected by software errors, macOS updates, hardware limitations, corrupted application data, or other technical circumstances.

Users should independently verify important values before relying on them.

10. Updates

We may provide updates to:

• fix errors;
• improve performance;
• maintain compatibility with macOS;
• improve existing functionality;
• add or modify features; or
• address security issues.

Mandatory statutory obligations concerning digital products remain unaffected.

11. Prohibited Use

You may not use MenuGoal:

• for unlawful purposes;
• to interfere with the application's operation or security;
• to infringe third-party rights; or
• in violation of Apple’s applicable terms.

12. Liability

We are liable without limitation in cases of intent or gross negligence, for injury to life, body, or health, under applicable product-liability law, where a guarantee has expressly been given, and where liability cannot legally be limited.

In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage typical for this type of contract.

Mandatory statutory liability and consumer rights remain unaffected.

13. Changes and Termination

You may stop using and uninstall MenuGoal at any time.

We may update these Terms where reasonably necessary due to changes to the application, applicable law, Apple’s platform, security requirements, or technical functionality.

Changes will not retroactively remove mandatory consumer rights.

14. Governing Law and Dispute Resolution

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.

Mandatory rules regarding jurisdiction remain unaffected.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies.
