Terms and Conditions for Awaitly

These Terms and Conditions apply to the use of the macOS application Awaitly, provided by:

1. Scope
These Terms apply to the use of Awaitly.
Awaitly is distributed through Apple’s Mac App Store. Purchases, payments, refunds, downloads, and use of the Mac App Store are also subject to Apple’s applicable terms and licence conditions.
Mandatory consumer rights remain unaffected.
2. Description of the Application
Awaitly is a macOS utility for keeping track of matters where the user has already taken action but is waiting for another person, organisation, or external event.
Users may create waiting items containing information such as:
- what they are waiting for;
- who or what they are waiting on;
- when the waiting period started;
- an optional follow-up date; and
- completion status.
Awaitly may calculate and display how long an item has been pending and help users identify when a follow-up may be appropriate.
3. User-Entered Information
Awaitly relies on information entered manually by the user.
The application does not independently verify whether an item is still pending, whether a response has been received, or whether a follow-up is actually required.
You are responsible for keeping your waiting items and follow-up dates accurate and up to date.
4. Follow-Up Dates and Reminders
Awaitly may allow users to set follow-up dates or otherwise indicate when action should be taken again.
Any displayed follow-up date or reminder is an organisational aid only.
Awaitly does not guarantee that reminders, notifications, or follow-up indicators will always be delivered or displayed at a particular time.
You remain responsible for important deadlines, contractual obligations, payment dates, legal deadlines, application deadlines, and other time-sensitive matters.
Awaitly should not be used as the sole reminder system for critical deadlines.
5. Third Parties
Awaitly does not control the persons, companies, organisations, platforms, or authorities you may be waiting for.
We do not guarantee:
- that another person will respond;
- that a payment will be made;
- that an application will be approved;
- that feedback will be provided;
- that a review will be completed within a particular time; or
- that any external process will reach a particular outcome.
Awaitly only helps you organise information about pending matters.
6. Licence
Subject to payment of any applicable purchase price and compliance with these Terms and Apple’s applicable rules, you receive a limited, non-exclusive, non-transferable right to use Awaitly on compatible Apple devices associated with your App Store account.
The application is licensed, not sold.
You may not unlawfully copy, redistribute, sublicense, reverse engineer, circumvent technical protections, or otherwise use Awaitly contrary to applicable law or Apple’s terms.
7. Purchase and Refunds
Where Awaitly is offered as a paid application, purchases are processed through Apple’s Mac App Store.
The price displayed by Apple at the time of purchase applies.
Payment processing, billing, cancellations, and refunds are generally handled by Apple.
Statutory consumer rights remain unaffected.
8. Local Data and User Responsibility
Awaitly is designed to store and process waiting items locally on your Mac.
You are responsible for:
- protecting access to your Mac;
- keeping your waiting items current;
- protecting confidential information you choose to enter; and
- maintaining appropriate backups where necessary.
We cannot recover application data that is lost, deleted, overwritten, or corrupted on your device.
9. Sensitive Information
Awaitly is a general organisational tool.
You should avoid entering unnecessary confidential, sensitive, financial, medical, legal, or personal information about yourself or third parties.
If you choose to enter such information, you are responsible for ensuring that you are legally permitted to store and process it.
10. Accuracy and Availability
We aim to provide a reliable application but cannot guarantee uninterrupted or error-free operation.
Functionality may be affected by software errors, macOS updates, hardware limitations, local data corruption, notification settings, or other technical circumstances.
Important information and deadlines should be independently verified.
11. Updates
We may provide updates to:
- fix errors;
- improve performance;
- maintain compatibility with macOS;
- improve follow-up functionality;
- add or modify features; or
- address security issues.
Mandatory statutory obligations concerning digital products remain unaffected.
12. Prohibited Use
You may not use Awaitly:
- for unlawful purposes;
- to unlawfully monitor or profile another person;
- to store information that you are not authorised to process;
- to interfere with the application's operation or security;
- to infringe third-party rights; or
- in violation of Apple’s applicable terms.
13. Liability
We are liable without limitation in cases of intent or gross negligence, for injury to life, body, or health, under applicable product-liability law, where a guarantee has expressly been given, and where liability cannot legally be limited.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage typical for this type of contract.
Mandatory statutory liability and consumer rights remain unaffected.
14. Changes and Termination
You may stop using and uninstall Awaitly at any time.
We may update these Terms where reasonably necessary due to changes to the application, applicable law, Apple’s platform, security requirements, or technical functionality.
Changes will not retroactively remove mandatory consumer rights.
15. Governing Law and Dispute Resolution
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.
Mandatory rules regarding jurisdiction remain unaffected.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies.
